Terms of Service

Who you are contracting with

These terms are a contract between you and Vino, trading as Motionpiece. Contractual notices and questions go to motionpieceai@gmail.com, which a person reads.

1. Account eligibility

You must be at least 18 years old, able to form a binding agreement, and using the service in compliance with applicable law. You are responsible for activity under your account and for keeping your sign-in secure.

2. Authorized repository access

Motionpiece connects to GitHub through a GitHub App that you install and to which you grant read-only access to the repositories you select. The App requests exactly two permissions — repository contents (read) and metadata (read) — and nothing else. You may change or revoke that access at any time from GitHub. You represent that you are authorized to grant access to the repositories you connect.

3. Your content and source code

You are responsible for the repository content, assets, and other materials you make available to Motionpiece. You retain ownership of your inputs. You grant Motionpiece a limited licence to access, process, and analyze that content solely to operate the service and generate your Motionpieces.

4. The film you receive

On payment, we assign to you all right, title and interest that we own and are able to transfer in the finished film we deliver to you.

To the extent any part of the film cannot be assigned, we grant you a perpetual, worldwide, irrevocable, royalty-free, fully paid-up licence to use, reproduce, modify, adapt, distribute, publish, display and perform it, to create derivative works from it, and to use it in advertising and marketing — for any lawful purpose, commercial or otherwise, without paying us anything further and without needing our permission. Your film carries your own branding and call to action.

Two things we are not promising, stated plainly rather than left to be discovered. We do not claim that a film is unique or exclusive to you: films are made with AI systems and shared production techniques, and comparable material may appear in work we produce for others. And we do not represent that every element of an AI-generated film qualifies for copyright protection in any particular country — that question is unsettled law, and no contract can settle it.

4a. Showing your film in our own marketing

We would like to show the films we make. We will not do it without asking. Showcase permission is a separate, explicit opt-in that you give per film, from your film's page, after it is delivered.

Accepting these terms does not grant it. Completing checkout does not grant it. Staying silent does not grant it. If you do opt in, you can withdraw at any time, and we will stop using the film in new material.

5. What an Early Access order includes

An Early Access order is one finished Motionpiece film for US$49, delivered as a clean 1080p60 export. There is nothing further to buy and nothing to unlock. You approve the storyboard and narration before production begins. After that approval, an order covers one finished film and does not include a customer-directed revision round. If something is defective on our side — a rendering fault, a factual error, a technical defect — we correct it; that is part of production, not a revision.

6. How your film is produced

Motionpiece uses AI systems throughout production. During Early Access, production is also run internally by our team, and every film is reviewed and approved by us before it is released to you. Production begins after you approve the storyboard and narration and after payment is confirmed.

We aim to deliver within 1 to 3 days of payment. That is a target, not a guarantee, and missing it is not by itself a breach of these terms.

If production fails, we first try to correct the problem or re-perform the work at our own cost. There is nothing more for you to pay while we do. That additional period runs for at most 14 calendar days after the original delivery target.

If we still cannot deliver a conforming film by the end of that period, we may cancel your order, and we will issue any refund or other remedy required by applicable law. We will tell you before we do it, not afterwards.

7. Payment and refunds

Orders are billed once through Stripe, before production starts. There is no subscription and no recurring charge. Your order is confirmed only when Stripe confirms payment.

All purchases are final and non-refundable, except where refunds are required by applicable law. See pricing.

8. Acceptable use

Do not use Motionpiece to infringe intellectual property, impersonate a person or organisation, or produce content that is unlawful, defamatory, deceptive, sexually explicit, hateful, harassing, or that promotes violence or self-harm. Do not use it to make claims about a product that are false or that you cannot substantiate. Do not attempt to access repositories or accounts you are not authorized to use, and do not attempt to disrupt, reverse engineer, or abuse the service or its underlying providers.

You are responsible for what your film says about your product. We may decline or stop an order that we believe breaches this section, and we will tell you if we do.

9. AI-generated output

Motionpiece uses AI systems to analyze your repository, develop a product understanding, write storyboards and copy, synthesize narration, generate music and sound, and generate and critique motion design. AI output can contain errors, inaccuracies, or claims that are not supported by your product. You are responsible for reviewing every Motionpiece, including any factual or performance claims, before you publish or distribute it.

10. Third-party providers

The service relies on third-party providers for authentication, model inference, media generation, rendering, storage, email, and payments. Your use of the service is also subject to the acts and availability of those providers.

11. Service availability

Motionpiece is in Early Access and may change, be interrupted, or be discontinued. We do not guarantee uninterrupted availability, and features may evolve.

12. Termination

You may stop using the service at any time. We may suspend or terminate access for violations of these terms or to protect the service, its users, or its providers.

13. Disclaimers

The service is provided on an "as is" and "as available" basis without warranties of any kind, to the fullest extent permitted by law. We do not warrant that generated output is accurate, fit for a particular purpose, or free of errors.

14. Limitation of liability

To the fullest extent permitted by law, Motionpiece and its providers are not liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, or data, arising from your use of the service.

15. Governing law and where disputes are heard

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in that province, without regard to conflict-of-law rules, and we prefer that disputes be heard in the courts of the Province of British Columbia.

This does not take away rights you cannot give up. We sell to customers around the world. If you live somewhere whose consumer-protection law gives you rights that cannot be waived by contract — including rights to cancel, to a refund, to a particular standard of service, or to bring a claim in your local courts — those rights apply to you and nothing in these terms limits them. Where local law and these terms conflict, local law wins to the extent it must.

We may decline or cancel an order we are not able to fulfil lawfully, or that we are not set up to support in your jurisdiction. If we do that before production, you are not charged; if we do it after, we refund you.

16. Changes to these terms

We will replace these interim terms with a full set of terms before Early Access sales open more widely, and we may change them at other times. The version in force when you pay is the version that governs your order — and it is recorded: when you place an order you accept the Terms, Privacy Policy and Purchase Terms by version, and we keep that record. Changing a document does not change any order already placed under the previous version. The current version of this page is 2026-08-02.
